Terms And Conditions

1.Detailed description of services

SKY EVENTS is a business in the Entertainment industry that offers an extraordinary Dining Experience.

2.Delivery policy

2.1. Subject to availability and receipt of payment, reservation requests will be processed within 24 hours. Confirmation of the booking, including a reference number, will be sent to the Customer via email. It is the Customer’s responsibility to provide SKY EVENTS with accurate contact details for booking purposes.

SKY EVENTS strives to ensure all prices are accurate, but errors may occur. If an error in the ticket price or date is discovered, SKY EVENTS will inform the Customer as soon as possible. The Customer will then have the option to either cancel the reservation and receive a full refund or confirm the reservation at the correct price and/or date.

Ticket prices are subject to change.

SKY EVENTS reserves the right to refuse and fully refund any reservation with notice to the Customer regarding the change. SKY EVENTS is not responsible for any losses or damages resulting from the reservation cancellation.

2.2. Please note that no children under the age of 10 years will be allowed at the sky dining table. Children must be at least 1.4 meters tall.

For safety reasons, there is a maximum weight limit of 120 kg (264 lbs) per individual for participation in the events. This weight restriction is in place to ensure the safety and comfort of all guests.

Customers exceeding the weight limit or not meeting the age requirements will not be permitted to partake in the event. Please note that no refunds will be issued if a Customer is unable to participate due to these restrictions.

2.3. Arrival time for registration is 45 minutes before the booking time/take-off. We strongly advise all customers to arrive 60 minutes before take-off for registration.

2.4. It is the Customer’s responsibility to plan their journey, allowing sufficient time for unexpected occurrences, weather conditions, traffic congestion, and other factors that may affect their arrival at the venue on time for the safety briefing. SKY EVENTS is not responsible for advising or informing the Customer of roadworks, incidents, or occurrences that may delay their arrival. Although every effort is made to adhere to the schedule, advertised timings may be delayed without notice. Under no circumstances will SKY EVENTS offer refunds or compensation for late or missed arrivals, regardless of the cause.

2.5. If the Customer fails to arrive for registration within the allocated time before the scheduled event, they will not be accepted for the Sky Dining Experience (no-show). The Customer will forfeit their allocated seat as well as the value of the ticket booked. No refunds will be provided for a no-show.

2.6. SKY EVENTS reserves the right to use any photography, videography, or audio captured by its agents during the event for editorial, trade, advertising, or other purposes. These materials may be used by SKY EVENTS or its partners in any manner and medium. Such assets may be altered or combined without restriction and without the Customer’s inspection or approval. By participating in the event, the Customer consents to the use of their image or likeness in this manner. If the Customer has any concerns about the use of their image or likeness, they may indicate their objections by ticking the appropriate box on the indemnity form completed prior to the event

2.7. Right of Admission reserved.

3. Return and Refunds policy 

3.1. The provision of services by SKY EVENTS is subject to availability and weather permitting.

3.2. SKY EVENTS management reserves the right to cancel the event at any time due to unfavourable conditions. If a cancellation occurs more than 24 hours prior to the event date, SKY EVENTS will offer the Customer the option to either reschedule the Sky Dining experience to another available date or receive a full refund of all money paid, without any further liability to the Customer.

3.3. Inclement weather

Customer safety is paramount, and events may be cancelled or shortened (with the event continuing on the ground) due to inclement weather.

If  SKY EVENTS cancels the experience due to weather conditions or if the event cannot start, Customers will be offered either a gift voucher valid for 3 months or the opportunity to rebook the event. SKY EVENTS contacts all affected Customers via email to outline their options and either issue a gift voucher or rebook their tickets. If the Customer requests a refund, a 10% administration fee will apply.

SKY EVENTS will not refund tickets if (i) the meal proceeds as planned, or (ii) the table is in the sky for 15 minutes or more at a safe operating height. In such cases, Customers will be given the option to rebook the event without meal service (experience only).

The new date of event must be communicated in writing by the Customer  within 3 months of the original event date, unless otherwise agreed upon in writing with SKY EVENTS.

3.4. Force Majeure

SKY EVENTS reserves the right to cancel, postpone, or abandon the event(s) due to circumstances beyond their reasonable control or unforeseen events, including but not limited to acts of war, earthquakes, floods, embargoes, riots, sabotage, governmental actions, or accidents. In such cases, no refund will be provided.

3.5. Cancellation due to COVID 19 or any other pandemic

In the event of a cancellation or postponement due to COVID-19 or any other pandemic, Customers will receive a gift voucher for the full value of their ticket, which can be redeemed for a future date. No refunds will be issued under these circumstances

3.6. Cancellation of services by the Customer

3.6.1. If the cancellation occurs more than 30 days prior to the event, a 15% cancellation fee will apply.

3.6.2. If the cancellation occurs between 30 days and 7 days prior to the event, a 50% cancellation fee will apply.

3.6.3. If the cancellation occurs less than 7 days prior to the event, a 100% cancellation fee will apply.

3.6.4. Notwithstanding the above, if suitable documentary proof is provided that the ticket holder is unable to attend due to death or hospitalization, no cancellation fee will apply.

3.6.5. Cancellation requests must be submitted in writing by the Customer via email to info@sky-events.co.za.

3.7. Request to reschedule booking by the Customer. 

3.7.1. Requests to postpone or reschedule bookings must be made no later than 24 hours prior to the event date. A postponement or rescheduling will incur an administration fee of R100 per ticket.

3.7.2. For group bookings of 10 or more guests, requests to postpone or reschedule must be made no later than 7 days prior to the event date. An administration fee of R100 per ticket will apply.

3.7.3. All requests to postpone or reschedule must be submitted in writing by the Customer via email to info@sky-events.co.za.

3.7.4. The new date for postponing or rescheduling the booking must be within 3 months of the original event date, unless otherwise agreed upon in writing with SKY EVENTS.

4. Customer Privacy policy

SKY EVENTS shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 5. Payment options accepted

Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the SKY EVENTS bank account, the details of which will be provided on request.

6. Card acquiring and security

Card transactions will be acquired for SKY EVENTS via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

7.Customer details separate from card details

Customer details will be stored by SKY EVENTS separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.

 8.Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

9.Responsibility

 SKY EVENTS takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

10.Country of domicile

This website is governed by the laws of South Africa and SKY EVENTS chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature,  40 Peter Place , Bryanston 2125

11.Variation

SKY EVENTS may, in its sole discretion, change this agreement or any part thereof at any time without notice.
